How can I as a credit intermediary join an extrajudicial settlement of consumer disputes?

During the registration via the online application on the FSMA website, the creditor or the credit intermediary must indicate in a checkbox that he or she undertakes to register with Ombudsfin. It has been agreed between Ombudsfin and the FSMA that it would be best to formalise the accession further immediately after the registration has been confirmed.

In principle, creditors and credit intermediaries with the status of tied agent or sub-agent who themselves or via their principal are already members of Ombudsfin do not have to do anything further.

For all other creditors and credit intermediaries with the status of agent in ancillary position or broker, the following applies:

For the accession with Ombudsfin to be in order, a completed and signed application for accession must be forwarded to Ombudsfin via ombudsman@ombudsfin.be. The application form can be found on pages 12 and 13 of the ‘Accession File’ published on www.ombudsfin.be (Instellingen/Leden).

Upon receipt of this document, the creditor/intermediary concerned becomes a member of Ombudsfin vzw. The accession file explains what this membership actually entails.
